Navigating Challenging Issues Related to Ending RCFE Residencies

Sometimes circumstances arise where an assisted living resident must be asked to leave the community. Navigating these awkward and difficult situations requires knowledge of the applicable statutes and regulations as well as some creative thinking. In this session, we will discuss the applicable legal requirements and provide practical tips on how to comply with the regulations while dealing with challenging resident issues that could lead to an eviction. We'll focus specifically on situations in which the resident's change in condition is inconsistent with continued residency in the community and where resident conduct is problematic.

Payam’s practice includes representing the firm’s health care clients in litigation and transactional matters. He works with hospitals, skilled nursing facilities, assisted living facilities, and other senior care and housing providers. He advises them on a broad range of issues such as Medicare and Medi-Cal reimbursement, licensure and regulatory issues, resident issues, and contract drafting. Payam also has experience with the legal concerns of nonprofit organizations, having prepared multiple tax exemption applications for the firm’s nonprofit clients.

Lori is a partner at the law firm Hanson Bridgett. Lori focuses her practice on helping her clients resolve health care-related disputes. She has been representing senior communities for over 20 years. She has represented long-term care facilities, senior care communities, and various health care providers in civil, administrative, and regulatory proceedings involving a wide range of issues, including resident discharges and evictions, federal deficiency and state citation appeals, and licensing actions. Lori's skills in managing and resolving disputes carry over to her work as a medical staff hearing officer and as a mediator.
